These Terms and Conditions constitute the general conditions of contract and, together with the corresponding Purchase Confirmations and other Contractual Documents of the Website, govern the relationship between Vinos Juguete, S.A. de C.V., hereinafter referred to as "Dominio de las abejas," "dominiodelasabejas.com," or "We," and users who use the Website and/or purchase items through electronic means and/or individuals who visit the Website and/or consult and/or use its content (the "Users"). Please read these Terms and Conditions carefully. By using this Website, you acknowledge that you have read and understood the Contractual Documents of the Website, including, but not limited to, these Terms and Conditions, and that you agree to be bound by the statements and clauses contained herein. Accordingly, we recommend that the "User" read these "Terms and Conditions" carefully each time they use the services of "dominiodelasabejas.com" as they may be updated and/or modified by "Dominio de las abejas" at any time, without personal and express notification to the "User."

 

SERVICE

 

“Dominio de las abejas” provides Users, directly or indirectly, access to and/or use of a series of online resources, services, and content through the website www.dominiodelasabejas.com, including, but not limited to: information on products and services for electronic purchases through the intermediation services of the "Website." "Dominio de las abejas" reserves the right to modify, add, or remove unilaterally, at any time and without prior notice, the offerings and the presentation and configuration of the "Website," as well as the conditions required to access and/or use the "Website." Likewise, the acquisition, purchase, sale, or obtaining of any item through the "Website" is at the sole and exclusive risk of the "Users."

 

In the event of any abuse by the customer/consumer where malicious intent against Dominio de las abejas is evident, Dominio de las abejas is exempt from shipping/acknowledging the customer's purchase. This includes issues arising from technological problems, system intermittencies, bank or card failures that the customer wishes to use for payment, or general site failures.

 

CONTENT

 

The "User" acknowledges and is aware that all information, data, text, software, sound, photographs, graphics, videos, messages, or other materials or elements contained on "www.dominiodelasabejas.com" and its page designs, whether published for the general public or transmitted via email, are the exclusive property of "Dominio de las abejas." The "User" or the person who enters their information for the subscription of special packages, old vintages, and tastings within "www.dominiodelasabejas.com" will be responsible for it and will indemnify "Dominio de las abejas" from any legal conflict.

 

3.1 Any individual over 18 years of age in Mexico can visit and consult the pages of the website “www.dominiodelasabejas.com” and, if they wish to purchase merchandise, must fill out the required information to make the purchase on the Website.

3.2 Delivery of items only within Mexico. This Website can only be used to purchase items to be delivered to an address located in Mexico. Notwithstanding the foregoing, “Dominio de las abejas” reserves the right not to accept a Purchase Order sent by a User without any liability for “Dominio de las abejas,” if it considers at its sole discretion that the delivery of the requested item is difficult to access or ship, given the location of the requested delivery address or the security, climatic, or social conditions at the time.

 

3.3 Restriction for minors or Users lacking legal capacity. To subscribe and purchase on this Website, the User must be at least 18 years old in Mexico. “Dominio de las abejas” does not knowingly encourage or allow minors to use this Website. If you are under 18 years old in Mexico or your contractual capacity is limited by applicable law, you should not send us Purchase Orders or use our Website "dominiodelasabejas.com" in any way.

3.4 The “User” acknowledges that, among other things, the corporate purpose of “Dominio de las abejas” is the wholesale commercialization of domestic and imported table wines, and that the content of the Website is directly related to this purpose, therefore it is intended for adults. Additionally, the “User” acknowledges that excessive consumption of some of the products offered on the Website may be harmful to health, and excess should be avoided.

 

PURCHASE AND SALE OF MERCHANDISE AND PAYMENT OF ITEMS

 

4.1 Information available to the user before the transaction. Before placing your order, you can review the characteristics of the merchandise and the “Terms and Conditions” applicable to the acquisition of the item (including the price in national currency (Mexican pesos), charges, payment methods, and special conditions that may apply to the delivery of the merchandise). This information is generally found in the information sheets associated with each product, fully complying with Article 76 BIS sections IV and V of the Federal Consumer Protection Law. All sales of items are governed by the Information Sheets of each product, these “Terms and Conditions,” the Purchase Order, the Purchase Confirmation, and the Delivery, Returns, and Cancellations Policy.

 

If you have any questions regarding the merchandise you intend to purchase, please contact the Customer Service Center of “Dominio de las abejas.” Before placing your Order, our Online Store will allow you to review the items you have selected, the quantity of products you have chosen to buy, and the address where delivery will be made, as well as the total price to be paid, including any additional charges for shipping.

 

4.2 Availability of items. The items displayed on dominiodelasabejas.com belong to our online store. Items are subject to availability and, therefore, may not be in stock when you place your Order. Please note that the fact that items are listed in the online store on the Website does not constitute a unilateral offer to sell these goods by “Dominio de las abejas.” Conversely, when you send us a Purchase Order, you are making an offer to purchase a certain quantity of goods from us. If we accept your offer, you will receive a Purchase Confirmation message. Generally, if we do not have sufficient stock of goods or require additional information from you to process the transaction, we will inform you of these situations before sending you a Purchase Confirmation and/or the item will appear as "Out of Stock" in the online store.

 

4.3 Online payments. Our online payment system only accepts payments through Visa, MasterCard, American Express, Mercado Pago, and PayPal credit and/or debit cards. Before completing your Purchase Order, you must have provided the address associated with your card and the card details through the Website, including the card number, the cardholder's name, the expiration date, and the card's security code. It should be noted that “Dominio de las abejas” does not store your credit card information; these data are obtained directly from you through a highly secure section of our Website. Occasionally, the payment processor requests authorization from your bank to confirm the purchase.

 

4.4 Once the purchase is made by the “User,” there is an implicit acceptance of the Terms and Conditions, and therefore “Dominio de las abejas” will send an email to the “User” informing them of the details of the purchase made. The sale is completed when the “User” receives a purchase confirmation message from “Dominio de las abejas” through the Website and at the email address provided, and provided that the merchandise has been previously paid for through the payment method selected by the “User.” Only after payment confirmation will the merchandise be released for delivery to the address specified by the User.

 

4.5 The “User” should consider that there are cases in which an order cannot be processed for various reasons. In this regard, “Dominio de las abejas” reserves the right to deny or cancel any order for any reason, at any time. Both parties agree that “Dominio de las abejas” has the exclusive authority to reserve the right not to accept any order as it deems fit, without this reservation implying the need for legal action, payment of compensation, or any penalty.

 

4.6 Risk of loss or deterioration of the item. You are responsible for the loss, damage, or deterioration of your merchandise from the moment it is delivered. The merchandise is considered delivered when the courier company leaves it at the address specified for delivery, regardless of whether the recipient signs for it or not. “Dominio de las abejas” assumes no responsibility for delays in delivery or inability to deliver when such delays or inability to comply result from force majeure, acts of God, and, in general, any cause beyond and/or outside the control of “Dominio de las abejas.”

 

INVOICING

 

The “User” must send an invoice request to the email enjambre@dominiodelasabejas.com as soon as possible from the date of purchase and always within the same month the purchase was made. When requesting the invoice, the “User” must provide the following information: reference order number, tax ID with homoclave, full name or business name, complete tax address including street, neighborhood, municipality or delegation, state, and postal code, the payment method used (debit card, credit card, PayPal, or others) and the intended use of the CFDI. In some cases, it may be necessary to provide a tax situation certificate to verify the provided information.

 

RETURN OF MERCHANDISE

 

Users may only return the purchased product in the following cases:

• If the product delivered is not what the User ordered.

• If the product is delivered with packaging that is not intact or is open.

The return of the merchandise will be made to the address indicated by the sales department of “Dominio de las abejas,” and a copy of the receipt or invoice must be attached.

 

To initiate a return, the User must send an email to the email address: enjambre@dominiodelasabejas.com with the following information:

• User's full name

• Order number

• Reason for the return

• Description of the problem and, if possible, photographic evidence

Upon receipt of the return request, “Dominio de las abejas” will review the case and, if applicable, proceed with the return process.

 

WARRANTY OF PRODUCTS

 

The warranty for the products is limited to the validity period indicated on the label or packaging of each product. If a product does not have a warranty period indicated, it will be considered to have a warranty period of 30 days from the date of purchase.
